Terms of Service

1 Accepting these terms

These Terms of Service ("Terms") form a binding agreement between you and DehSuh ("DehSuh", "we", "us", or "our"). They govern your access to and use of our website, mobile experience, and related services (together, the "Service"). By accessing or using the Service — whether or not you create an account — you agree to these Terms and to our Privacy Policy, which is incorporated here by reference.

If you don't agree with these Terms, please don't use the Service. You must be able to form a legally binding contract to use DehSuh. If you use the Service on behalf of a business or organisation, you confirm you're authorised to bind it to these Terms.

2 Our role as a directory

DehSuh is a venue and directory — a place to advertise and to discover listings. Like directory platforms we provide the tools that connect people, but we are not a party to any agreement, rental, sale, or other transaction that results from a listing or an inquiry.

• We do not own, inspect, endorse, or take possession of any listed vehicle, item, or space.
• We do not process bookings, collect rental or sale payments between users, or take a commission on any deal.
• Listers are solely responsible for their listings, pricing, availability, conduct, and for any agreements they make with the people who contact them.
• When you contact a lister, or a lister responds to you, you deal with that person directly and outside our control.

We don't guarantee the accuracy, quality, safety, legality, or availability of any listing, or that any lister or user is who they claim to be. Any verification we perform is to help protect the platform — it is not an endorsement or a guarantee.

3 Eligibility & your account

You must be at least 18 years old to use the Service, create an account, list, or submit an inquiry. By using DehSuh you confirm that you meet this requirement and that the information you give us is accurate, current, and complete.

• You're responsible for keeping your login details confidential and for all activity that happens under your account.
• Don't impersonate anyone, misrepresent your identity or affiliation, or create an account for someone else without authority.
• Tell us promptly if you believe your account has been accessed without your permission.

You can stop using the Service or close your account at any time. We may decline, suspend, or remove accounts as described in Section 11.

4 Becoming a lister & verification

Anyone can create a free account as a regular user. To post listings, a user can apply to become a lister. Because verification helps protect everyone, becoming a lister requires submitting official documents and details, which may include government-issued identification and, for business listers, business name and address, business registration, tax type, Tax Registration Number (TRN), and supporting tax documents.

We may accept or decline any application, and may request further information, at our discretion. We may use third-party services to help verify what you submit, and you authorise us to request, receive, and store that information for these purposes. As noted above, verification does not make us a party to your dealings and is not a guarantee about any user.

5 Subscriptions, slots & fees

Listing on DehSuh requires an active subscription plan. Each plan grants a number of listing slots — the number of listings you can keep published at once. Deleting a listing frees a slot for reuse, subject to your plan's limit.

• Applicable fees are shown before you confirm a purchase. By subscribing, you agree to pay the fees for the plan you select.
• Payments are handled by third-party providers (for example, bank transfer or PayPal). We don't collect or store full card or banking credentials ourselves.
• Where a plan auto-renews, it continues until you cancel. Cancelling stops future renewals but does not retroactively refund the current period.
• Except where required by applicable law, subscription fees are non-refundable, including for unused slots or partial periods.
• We may change plans, slot allowances, features, or pricing. We'll give reasonable notice of material changes, and changes won't affect a period you've already paid for.

We charge listers for subscriptions only. We do not charge users to browse or to make inquiries, and we take no commission on any transaction between users.

6 Listing rules & standards

As a lister, you're responsible for everything in your listings. You agree that:

• Your listings are accurate, complete, and not misleading, and you'll honour the details and pricing you advertise.
• You own, or have the right to advertise, whatever you list, and listing it doesn't breach any agreement with a third party (such as a lease or finance agreement).
• Your listings, and anything you offer, comply with all applicable laws and don't involve stolen, prohibited, unsafe, counterfeit, or illegal items, or anything you're not permitted to offer.
• You have the rights to any photos, descriptions, and other content you upload, and they don't infringe anyone else's rights.

We may refuse, edit the placement of, remove, or rank listings at our discretion — for example, where a listing breaches these Terms or could harm the platform or its users. We're not obligated to monitor listings, but we may.

7 Dealing with other users

When you contact a lister or respond to an inquiry, you're connecting with another person directly. We don't screen users beyond the verification described above, and we're not responsible for their conduct, their listings, or the outcome of any deal.

Use good judgement and ordinary caution: confirm details independently, agree your own terms, and take sensible steps to keep yourself safe when arranging to meet or transact. Any contract you enter into with another user is solely between you and that person, and DehSuh is not a party to it and has no responsibility for it.

8 Content & intellectual property

The Service itself — including its software, design, branding, and the DehSuh name and logo — belongs to DehSuh or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, reverse engineer, scrape, or build a competing or derivative product from the Service.

You keep ownership of the content you submit (such as listing text and photos). By submitting content, you grant DehSuh a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, and promote that content in connection with operating and marketing the Service. You confirm you have the rights needed to grant this licence and that your content doesn't infringe anyone else's rights.

We respect intellectual property rights. If you believe content on the Service infringes your rights, contact us using the details in Section 17 with enough information to identify the work and the material in question, and we'll review it.

9 Prohibited activities

When using the Service, you agree not to:

• Break any applicable law or regulation, or post false, inaccurate, misleading, defamatory, or fraudulent content.
• Provide false identity, verification, or listing information, or impersonate any person or business.
• Harass, threaten, abuse, stalk, or discriminate against anyone, or collect or store other users' personal information beyond what a legitimate dealing requires.
• List or facilitate anything illegal, stolen, unsafe, counterfeit, or otherwise prohibited.
• Infringe anyone's intellectual property, privacy, or other rights.
• Scrape, crawl, harvest, or systematically collect data from the Service, or use it to build a database, directory, or competing service.
• Introduce malware, attempt to gain unauthorised access, probe or test our systems, or interfere with or place an unreasonable load on the Service.
• Circumvent any security, access, or usage limits, or evade a suspension or termination.
• Send spam or unsolicited commercial messages through or about the Service.

Child safety. We have zero tolerance for any content or conduct that sexually exploits, abuses, or endangers minors. Any such activity will result in immediate removal and account termination, and we will cooperate with law enforcement as required.

10 Third-party services & links

The Service relies on third-party providers, and listings may link to external sites or contact channels we don't control. For example, we use Google Maps Platform for location and mapping features, and your use of those features is also subject to Google's terms. We're not responsible for third-party sites, services, or content, and we encourage you to review their terms and privacy policies.

11 Suspension & termination

You may stop using the Service or close your account at any time. We may limit, suspend, or terminate your access, and remove listings or content, at our discretion — including where we believe you've breached these Terms or where necessary to protect the Service or others, to the extent permitted by law.

If we terminate your account for breach, you may not be entitled to a refund of any subscription fees. Sections that by their nature should survive — including content licences, disclaimers, limitation of liability, indemnification, and governing law — continue to apply after your access ends.

12 Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don't warrant that the Service will be uninterrupted, secure, or error-free, or that any listing or information on it is accurate, current, complete, or reliable.

Because DehSuh is a directory and not a party to any deal, we make no representation and give no warranty about any listing, lister, user, vehicle, item, space, or transaction. We don't endorse, vouch for, or assume responsibility for the conduct of any user, the condition or legality of anything listed, or the outcome of any dealing between users. You use the Service, and deal with other users, at your own risk.

13 Limitation of liability

To the fullest extent permitted by law, DehSuh and its owners, officers, employees, and agents won't be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or relating to your use of the Service.

In particular, we're not responsible for any loss or harm arising from listings, the conduct of any user, the accuracy of any listing, or any agreement, dealing, or dispute between users. Where liability cannot be excluded, our total aggregate liability arising out of or relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or US$100. Nothing in these Terms limits any liability that cannot lawfully be limited.

14 Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless DehSuh and its owners, officers, employees, and agents from any claims, liabilities, damages, losses, and reasonable expenses (including legal fees) arising out of or connected with your use of the Service, your listings or content, your dealings with other users, or your breach of these Terms or of any applicable law.

15 Governing law & disputes

DehSuh is based in Jamaica and available worldwide. These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of Jamaica, without regard to conflict-of-law rules — except where the mandatory consumer laws of your own country give you rights that can't be overridden by agreement.

If a dispute arises, please contact us first using the details in Section 17 so we can try to resolve it informally — that's usually the quickest path for everyone. If we can't resolve it that way, the courts of Jamaica will have jurisdiction, subject to any mandatory rights you may have to bring a claim in your own country of residence.

16 Changes to these terms

We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above, and for significant changes we'll provide a more prominent notice. Your continued use of the Service after an update means you accept the revised Terms. If you don't agree to a change, please stop using the Service and, if you wish, close your account.
